Terms of Service and Privacy Policy for NonOrdinary 

Introduction 

Welcome to NonOrdinary! We are committed to fostering a supportive environment for members. By using our platform, you agree to the following Terms of Service and Privacy Policy. Please read them carefully. 

1. Acceptance of Terms 

By being part of NonOrdinary, you agree to be bound by these Terms of Service and Privacy Policy. If you disagree with any part of these terms, you must not use our platform. 

2. Eligibility, Member Profiles, and Personal Information 

a.Membership is open to individuals who are at least 18 years of age. By participating in NonOrdinary, you agree that you meet the eligibility requirements. 

b. Authentic Information: Members are required to provide authentic and accurate information when creating their profiles on NonOrdinary Society. Impersonation or misrepresentation of personal information is prohibited.

c. Responsibility for Account Information: Members are responsible for maintaining the confidentiality of their account information, including their password. Any sharing of account information with others is strictly prohibited. Members are solely responsible for any actions taken under their accounts, whether or not they have authorized such actions.

d. Liability for Discrepancies: NonOrdinary is not liable for any discrepancies in the information provided by members. Members who provide false or misleading information may face consequences, including but not limited to warnings, temporary or permanent suspension of their accounts, or legal action, as applicable.

3. Privacy Policy 

We take your privacy seriously. We collect only the necessary information to provide you with the best possible experience on our platform. This may include your name, email address, and any other personal information you choose to share with us. 

a. Information Collection: We collect information you provide to us when you register, create a profile, or otherwise interact with our platform.

b. Information Use: We use your information to provide, maintain, and improve our services, and to communicate with you about our platform.

c. Information Sharing: We will not sell or share your personal information with third parties without your consent, except when required by law, to enforce our Terms of Service, or to protect our rights and the safety of our users.

d. Data Security: We implement appropriate security measures to protect your information from unauthorized access, disclosure, or alteration.

e. Data Retention: We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, or as required by law.

4. Digital Millennium Copyright Act Notice and Intellectual Property 

All content on NonOrdinary Society, including text, graphics, logos, and images, is the property of NonOrdinary Society or its content contributors and is protected by copyright and trademark laws. 

a. DMCA Compliance: NonOrdinary Society respects the intellectual property of others. We may, in appropriate circumstances and at our sole discretion, terminate the access of users who infringe any copyright, trademark, patent, trade secret, or other intellectual property rights of others.

b. Reporting Infringement: If you believe that your work has been copied and is accessible on our website in a way that constitutes infringement, or that our website contains links or other references to another online location that contains material or activity that infringes your rights, you may notify us by providing us the information required by the U.S. Online Copyright Infringement Liability Limitation Act of the U.S. Digital Millennium Copyright Act, 17 U.S.C. §512.

5. Governing Law and Jurisdiction 

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts and the laws of the United States, without giving effect to any principles of conflict of law. You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the state or federal courts located in Boston, Massachusetts, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. The parties specifically disclaim applicability of: (i) the United Nations Convention on the Sale of Goods. 

6. Content Ownership and Usage Rights 

You are solely responsible for the content you post, share, or transmit with or at NonOrdinary. 

a. Community Ownership and Irrevocable Permission: All content created and posted in NonOrdinary becomes the property of the community. While members retain their rights to their content, they also grant NonOrdinary an irrevocable, royalty-free license to use, reproduce, modify, distribute, and display the content for the purpose of operating and promoting the community.

7. Responsible and Legal Posting of Explicit Content

a. Definition: In the context of NonOrdinary, explicit content refers to any material that may be considered adult, mature, or potentially offensive, including but not limited to nudity and explicit language.

b. Original Content Only: Members who wish to post explicit content must ensure that the content is original and not copied or distributed from other sources. Sharing links to explicit content hosted on external websites is strictly prohibited.

c. Legal Compliance: All explicit content posted on NonOrdinary must comply with applicable laws and regulations, including age. Content that is illegal, promotes illegal activities, or infringes on the rights of others is strictly prohibited.

d. Respectful and Relevant: Explicit content posted on NonOrdinary must be relevant to the community’s focus on personal growth, expansion, aliveness, deep conversations, and skill-building. Members are expected to be respectful and considerate when sharing explicit content, taking into account the preferences and sensitivities of other community members.

e. Reporting and Moderation: If you come across explicit content that you believe violates these guidelines or is otherwise inappropriate, please report it to our community moderators or administrators immediately. We will review the reported content and take appropriate action, which may include removing the content, issuing a warning, or suspending or terminating the responsible member’s account.

f. Liability: NonOrdinary Society is not liable for any explicit content posted, shared, or transmitted by its members. While we strive to maintain a bravely safe and supportive environment, we cannot monitor or control all content on our platform. By engaging in NonOrdinary Society, you acknowledge and agree that we are not responsible for any explicit content or the consequences of such content being posted, shared, or transmitted by our members.

8. Direct Messages and Chat  

a. Purpose: NonOrdinary may provide direct messaging or chat features to facilitate communication between and among members. Members are expected to use these features responsibly and in accordance with the Community Understanding Docs and other guidelines outlined in these Terms of Service.

b. Respectful Communication: Harassment, bullying, discrimination, or any other form of disrespectful behavior is strictly prohibited.

c. Unsolicited Content: Members must not send unsolicited or unwanted content to others, including, but not limited to, spam, promotional materials, or explicit content.

d. Reporting Misconduct: If you encounter any behavior or content in direct messages or chat which violates, or seems to violate, these guidelines, please report it to our community moderators or administrators immediately. We will review the reported content or behavior and take appropriate action, which may include removing the content, issuing a warning, or suspending or terminating the responsible member’s account.

9. Member Responsibility and Content Moderation 

a. Content Moderation: NonOrdinary is not obligated to review all content instantly, nor can we monitor direct messages or chat conversations.  We reserve the right to modify or delete content that does not adhere to our rules and regulations in order to protect the rights and safety of our members. This includes, but is not limited to, content that is illegal, threatening, or otherwise in violation of these Terms of Service. 

10. Purchasing Tickets for Events and Subscriptions for Trainings and Community Membership 

a. Event Tickets: NonOrdinary may organize events (workshops, conferences, retreats, etc). To attend these events, you may be required to purchase tickets through our platform or through authorized third-party ticketing services. All ticket sales are subject to availability and may be subject to additional terms and conditions imposed by NonOrdinary or the third-party ticketing service.

b. Subscription-based Trainings and Community Membership: NonOrdinary offers subscription-based access to trainings, courses, or premium community features. When purchasing a subscription, you agree to pay the applicable fees and any applicable taxes, and you authorize NonOrdinary or its authorized payment processor to charge your chosen payment method. All fees are non-refundable, except as required by law or as otherwise stated in our Refund Policy.

c. Automatic Renewal: Unless otherwise stated, subscriptions will automatically renew at the end of the subscription period. You may cancel the automatic renewal at any time by following the instructions provided in your account settings or by contacting our administrative support.

d. Cancellation and Refund Policy: You may cancel your subscription at any time. However, all fees are non-refundable, and are not pro-rated, except as required by law or as otherwise stated in our Refund Policy. If you are not satisfied with your subscription, please contact our customer support to discuss your concerns.

e. Price Changes: We reserve the right to change the prices of our events, trainings, or subscriptions at any time. If you have an active subscription, we will notify you of any price changes before they take effect. Your continued use of our platform or services after a price change constitutes your acceptance of the new fees.

f. Billing Disputes: If you believe that you have been charged in error, please contact our customer support immediately to resolve the issue. We will review your claim, and if we determine an error has occurred we will issue a refund or credit as appropriate.

11. Disclaimer of Warranties and Limitation of Liability 

NonOrdinary is provided on an “as-is” basis. We make no warranties or representations of any kind regarding the platform or its content. You agree that your use of NonOrdinary is at your sole risk, and we shall not be liable for any damages arising out of your use of our platform. 

12. Changes to Terms of Service and Privacy Policy 

We may revise these Terms of Service and Privacy Policy from time to time. By continuing to participate in NonOrdinary, you agree to be bound by the most current version of these terms.
